"Museum"). We are committed to making your experience on our Web site
safe, satisfying, and productive. The Web site chronicles the
assassination and legacy of President John F. Kennedy and provides
audiences with the tools to navigate contemporary culture within the
context of presidential history. This Web site, including all pages,
sections and portions of it and all services, features and information
found at the Web site are referred to as the "Web site" or the "Site"
throughout these Terms of Use of the Web site.
PLEASE READ THESE TERMS OF USE OF THE WEB SITE (THE "AGREEMENT")
CAREFULLY BEFORE USING THIS WEB SITE. THEY APPLY TO ALL USERS OF THE

Site Privacy Policy
Sometimes the Web site will request that you provide us with
information. We gather and store this information along with
information collected from other users of our site. Depending on the
information or service you are accessing, you could be asked at various
times to provide your name, email address, and/or certain other
information such as your preferences for future Museum exhibits, online
information, other possible Museum services or general demographic
information. On other occasions, such as when you decide to purchase
items from our online store, we may request your credit card number to
complete the transaction along with contact information to ensure
proper delivery of the items which you have purchased. Generally
speaking, the information that we collect helps us provide more of the
content, products, and services that you want when you want them.
The Museum does not sell or share with third parties any
personally identifying information, without first receiving your
permission at the time such information is submitted. General
information and personal information in the aggregate may from time to
time be shared with third parties. This information is, however, in no
way traceable to the user.
We understand that your privacy is very important to you. This is why
we believe that all visitors to our Site deserve to be informed about
the types of information we collect and the manner in which we collect
and disseminate it. Because the Internet is a rapidly evolving medium,
we may change our privacy policy from time to time. We encourage you to
return to this privacy policy section occasionally to see if any
changes have been made and to advise us as soon as possible if you wish
us to cease using personally identifying information you have
submitted, as permitted by our privacy policy.
Types of Information That We Collect and How We Collect
and Use Such Information
General Information.
The Museum gathers general information about all users
that visit our site regarding use of the Site. However, this general
information does not reveal the user's specific identity. For instance,
we may know how many users visit the "General Information page" today,
but we do not know those users' names, addresses, telephone numbers or
any other personal information. Indeed, you can be assured that we will
not collect nor use any such personal information, unless you
voluntarily submit such information to us through our registration
process, signing the Guest Book/Memory Book, or by other voluntary
correspondence with us. The types of general information that we do
collect include the kind of operating system your computer uses, your
browser type and version, your browser language, your Internet service
provider, and certain "click-stream" information, such as how you use
and navigate our site and the length of time which you spend here at
different pages and sections of the Site using the various services,
information and features. We use this data and information ("General
Information") to better address the user's overall experience at
www.jfk.org.
Voluntary Submission of Personal Information.
While using our Web site, you can voluntarily
register or communicate with us. Registration is entirely optional
unless you wish to obtain a media kit or are accessing the online
Group/Educational tour or Facilities Rental Registration/Request pages.
If, as an individual guest, member of the media, or representative or
employee of a business or other organization, you do choose to register
or communicate with the Museum, then we will gather and store some
personal information or information about your organization or
affiliation which you have submitted during these processes into a
database such as: your name, your email address, mailing address,
information from other specific fields such as gender etc., postal
code, and perhaps some general demographic information ("Personal
Information"). The Museum may share General Information and/or Personal
Information in the aggregate ("Aggregated Data") such as your postal
codes, gender and/or age with unaffiliated third parties, but we share
this Personal Information only in the aggregate, i.e., the Personal
Information which we share is not traceable to a specific user. For
example, we may provide an advertiser information that of the total
number of users who viewed a certain electronic exhibition on our Site,
75% of such viewers were male.
Additionally, from time to time we may ask you for other information
such as your interests or other general demographic information. All of
these types of questions call for Personal Information which would be
submitted by you on an entirely voluntary basis. We will only use your
email address to correspond with you (1) as necessary, about specific
inquiries you make at the Site, e.g., to follow up regarding purchases
you have made at our online store or in response to a request for a
tour or use of the facilities made by using the Group/Educational Tour
and Facilities Rental Registration/Request procedure (the "Online
Request Form"), or (2) to send you information periodically concerning
new features on the Site, updates of Museum information and products
and services made available through the Site. If you do not wish to
receive information about the Site or our products and services via
email, you can choose not to by simply following the instructions on
the email or by sending an email to webmaster@jfk.org.
We do not share specific personal information that you
provide us with any unaffiliated third parties, with two exceptions.
First, if in connection with our monitoring of the Site and submissions
from users to the Site, we believe in good faith that disclosure is
required, we may disclose information to third parties in connection
with (1) protecting the security, property, assets and/or rights of the
Site from unauthorized use or misuse of the Site, or (2) asserting and
enforcing our rights in content, services, features, data and
information or other proprietary rights associated with the Site.
Second, we may disclose information when required to do so by law, such
as with a subpoena or in response to another valid legal process.
Children 12 and Under.
Use of the Site.
Children under the age of 13 are free to explore and view
age-appropriate information at the Site; provided, however, that the
parent or guardian for the child must assume all responsibility for
ensuring that the child's use of the Site is appropriate. While we do
not specifically solicit personal information from children, it is
possible that children using the Site may want to submit information
about themselves in registering at the Site or signing the Guest
Book/Memory Book or at some of the "Public Areas" (defined in the
Section called "Use of Public Areas - General Caveat"). No one under
age 13 may submit any personally identifying information at the Site
without first providing the Museum with consent from a
parent or guardian according to the procedures
posted at the Site (which may be accessed at the areas which permit
submission of personally identifying information) and as explained
below. In any section of the Site that requests personal information,
visitors 12 years of age and under are reminded to obtain permission
from an adult before supplying the requested information.
Parental Consent.
The Museum does not knowingly collect any personally identifying
information about users under 13 indirectly, e.g., through the use of
cookies, or directly without first receiving the proper permission. In
any case, should the Museum inadvertently acquire personal data from a
user under the age of 13 in connection with the Site, whose parent or
guardian has not provided consent in advance, the Museum will not
knowingly provide this data to any third party for any purpose
whatsoever unless we have disclosed our intent to distribute the data
when the Personal Information is collected. In general, Personal
Information provided by children under age 13, as well as that of
persons ages 13 to 18, is used in the same manner as Personal
Information of users over age 18, e.g., for sending notices regarding
products and services that may be of interest or responding to specific
requests for information or to purchase something from the Museum store
or to schedule a tour of the Museum. In addition, if the Museum uses
Personal Information collected at the Site for promotional or marketing
purposes, including sharing the Personal Information with unaffiliated
third parties, then Personal Information from children ages 13 - 18 and
for those under age 13 for whom consent is received may be shared with
the unaffiliated third parties.
If at any time a parent or guardian who
has given permission for the submission of Personal Information about a
child under age 13 wishes to review the information submitted or delete
any of it from Museum records or withdraw permission
for use of all or any part of it, such parent or guardian may contact

Shopping in Our Store
You may purchase products and services from our online store whether or
not you register with the Site. If you choose to make purchases, you
will be asked to supply credit card and other billing, shipping and
contact information. The contact information which you supply will be
used to fulfill your order, to get in touch with you should we need to
regarding your order, or to notify you of special or other featured
offers in our store. Your financial information will only be used to
process your order and to track sales of items and will not be shared
with others except for third-party providers of services to the Museum
in connection with fulfilling your order. The Museum uses security
measures for all online store purchase information, but cannot guaranty
absolute security at all times. The Museum will use its best efforts to
provide a safe and secure means of transferring this data across the
Internet.
Cookies
Use of cookies by the Site.
To enable many of the features available on the Museum Web site, we
will assign one or more "cookies" to your Internet browser. Cookies,
among other things, speed navigation through our Site, keep track of
information so that you do not have to re-enter it each time you visit
our Site, and provide you with customized content. A "cookie"
is a small text file that contains a unique identification number that
we transfer and store on your computer's hard drive. Cookies by
themselves cannot be used to find out the identity of any user. This
unique identification number automatically identifies your browser -
but not the user - to our computers whenever you interact with our Web

You are welcome to sign the Guest Book/Memory Book
and submit comments about your visit to the Museum and/or this Web site

services which may be found at this Web site from time-to-time
(collectively, the "Public Areas"), subject to and provided you abide
by, the terms, restrictions, limitations and conditions stated in this

however, please keep in mind that whenever you submit personal
information online, that information can be collected and used by

Changing Your Information; Revolving your Registration

protected by the Copyright Laws of the United States ("U.S. Copyright

Frequently Asked Questions (FAQs)
1) May I use Images and Text from the Museum
Web site on a file server for my school or museum?
Yes. If the material is limited to a class
or a group of students and researchers and for a limited time of no
more than a semester of 3-4 months. Also, such Images and Text should
be properly cited, as required by the Agreement for use of the Web site.
2) May I use Text, Images or other Information
from the Web site on my personal Web page?
No. The Images, Text and all other
Information are the intellectual property of the Museum or third
parties with whom the Museum has a licensing agreement. Users are,
however, free to link to the Museum's Web site through their homepage,
provided such link is created in accordance with the Agreement for use
of the Web site.
3) May I transfer Images or Text or other
Information from the Web site to another format such as on a CD or in
print or save them upon my hard drive?
No. Any transferring of Images, Text or
other Information from the Museum's Web site that would violate the
copyright laws of the United States or the Agreement for use of the Web
site is prohibited.
4) May I use selected Images or Text in an
academic report?
Yes. This is covered under fair use and
allowed by the copyright laws of the United States. The Text or Image
must be correctly cited, and proper credit must be given, in accordance

5) May I use selected Images or Text or other

Museum Trademarks.

is protected under The Lanham Act, 15 United States Congress
§§1051-1127, as well as by other trademark laws.
These distinctive Trademarks are proprietary marks and represent the
Museum and cannot be used in any way without the written consent of the
Museum. In addition, all logos, page headers, custom graphics, images,
buttons, graphics, icons, symbols, the names and descriptions of
products and service and features, company and trade names and other
marks found at the Site are proprietary property of, and may
additionally be registered, service marks, trademarks, trade names
and/or copyrighted materials ("Trademarks") of the Museum or third
parties and are subject to all laws protecting same and to the terms of
this Agreement, including without limitation, the restrictions and
limitations on use of the Information.
Third Party Trademarks.
The Trademarks found on the Web site that do not
belong to the Museum may not be used without express consent of the
owner. The use of these Trademarks on the Web site by the Museum should
not be construed as granting any permission to you for use of said
Trademarks without the written consent of the proper owner.
Restrictions, Limitations and Conditions
of Use
Your rights to this Site are given on the condition
that you use the Site in accordance with this Agreement. You may not
use the Site for any unlawful or illegal purposes and, in connection
with your access and use of this Site, you may not: (1) solicit or

Changes to Terms; Entire Agreement
This Agreement constitutes the entire and exclusive agreement between
you and the Museum regarding the Site and its use, and supersedes all
other agreements, understandings and communications, if any, oral or
written. The Museum retains the right to modify this Agreement at any
time without notice or warning. The user is bound to these changes and,
therefore, should periodically revisit these terms for review and to
comply with all changes or, if at any time the user cannot comply with
the terms and conditions of it, terminate this Agreement and
discontinue use of the Site.
Governing Law; Requirements for Lawsuits
The laws of the State of Texas, excluding its
conflict-of-law principles, shall govern the use of the Museum Web site
and purchase of items from the Museum Store and any disputes related to
that use. All visitors to and users of the Web site hereby expressly
agree that, with respect to any legal proceeding related either
directly or indirectly to this Agreement, the privacy policy, or the
Web site and use of it, and any items purchased at or through the Site:
(1) that jurisdiction and venue shall be solely and exclusively in the
state courts situated in Dallas County and the federal courts in the
Northern District of Texas situated in Dallas, Texas, as applicable,
and agree to submit to the exclusive personal jurisdiction of such
courts and hereby appoint the Secretary of State of Texas as agent for
service of process; and (2) to the extent allowed by applicable law,
that any claims or causes of action must be instituted within two (2)
years from the date upon which such claim or cause arose or accrued.
The Museum's failure to enforce any terms of this provision shall not
be construed as a waiver of any right mentioned above. The prevailing
party in any such legal proceeding, disputes or claims is entitled to
recover its attorneys fees and costs of litigation.
Child Online Protection Act Notification
Pursuant to 47 U.S.C. Section 230(d) as amended, the Museum hereby
notifies you that parental control protections (such as computer
hardware, software, or filtering services) are commercially available
that may assist you in limiting access to material that is harmful to
minors. Information identifying current providers of such protections

Notice and Procedure for Copyright Infringement Claim
Pursuant to 17 U.S.C. Section 512, as amended by
Title II of the Digital Millennium Copyright Act (the "Act"), we
reserve the right, but not the obligation, to terminate your license to
use this Site if we determine in our sole and absolute discretion that
you are involved in any activity which may be infringing, including
alleged acts of first time or repeat infringement, regardless of
whether the material or activity is ultimately determined to be
infringing. The Museum accommodates and does not interfere with
standard technical measures used by copyright owners to protect their

In addition, any written notice regarding any
defamatory or infringing activity, whether of a copyright, patent,
trademark or other proprietary right, should be sent to the designated
agent listed above and must include the following information:
A. A physical or electronic signature of a person
authorized to act on behalf of (1) the owner of an exclusive right that
is allegedly infringed or (2) the person defamed.
B. Identification of the copyrighted work claimed
to have been infringed, or, if multiple copyrighted works at a single
on-line site are covered by a single notification, a representative
list of such works at that site. Similarly for other types of
infringing materials, a list of such materials.
C. Identification of the material that is claimed
to be infringing, to be the subject of infringing activity, or that is
claimed to be defamatory and that is to be removed or access to which
is to be disabled, and information reasonably sufficient to permit us
to locate the material.
D. Information reasonably sufficient to permit us
to contact you, such as your address, telephone number, and/or
electronic mail address.
E. A statement that you have a good faith belief
that use of the material in the manner complained of is not authorized
by the copyright or other proprietary right owner, its agent, or the law.
F. A statement that the information in the
notification is accurate, and under penalty of perjury, that you are
authorized to act on behalf of the owner of an exclusive right that is
allegedly infringed or on behalf of the person defamed.
